The regulatory landscape
is complex. MOMS isn’t.
Three federal laws govern how labs can form relationships with collection providers. MOMS was designed from the ground up to resolve all three — through its contracting structure, automated payment system, and platform architecture.
We are contracted with MOMS, not the vendor. This allows us to access way more providers than we otherwise would if we needed to get an agreement with the vendor directly. MOMS handles our invoicing — so when a patient goes for a lab test, our account gets charged directly, taking the burden off our plate. MOMS takes on a huge list of things that I used to have to do manually, which frees me up to do a lot of other things.
Stark Law prohibits direct financial relationships between labs and the physicians or entities that refer patients for collections. Forming direct agreements with collection sites creates exposure.
MOMS resolution: Labs contract with MOMS exclusively — not with any collection site directly. One compliant agreement with MOMS unlocks the entire MAP network without creating any direct financial relationships.
AKS prohibits offering or paying anything of value to induce referrals for services covered by federal healthcare programs. Volume-based or per-referral compensation to collection sites raises significant risk.
MOMS resolution: MAP compensation is structured as fair market value for a collection service performed — not tied to referral volume or federal program status. No direct financial relationship exists between the lab and the MAP.
EKRA expanded anti-kickback prohibitions to clinical lab testing regardless of payer, prohibiting volume-based payments to collection sites and patient brokering arrangements.
MOMS resolution: Automated invoicing through MOMS removes referral-based billing entirely. MAPs receive a flat per-collection payment regardless of test type or payer — eliminating EKRA exposure at the structural level.

Labs/Clients sign a Master Services Agreement and a Business Associate agreement as part of onboarding. The agreements cover all MAPs in the network and are structured to satisfy Stark, AKS, and EKRA requirements.
Upload your test kit specifications, collection requirements, prep instructions, and any required materials into the Lab Portal. The platform distributes your requirements to every MAP automatically.
Patients schedule collections, MAPs perform draws, specimens ship to your lab prepared to your specifications. Invoicing and MAP payments are handled automatically. Your team generates results.
